Based on a complaint by a US based NRI a local private builder was pulled up by the Consumer Court in Mohali and was awarded a penalty fine of Rs. 2.85 lakh. The charges levied against the builder were delay in giving possession of the flat bought by the NRI and using below standard materials in constructing the same.
The District Consumer Disputes Redressal Forum after hearing the complaint directed the defaulting builder N K Sharma Enterprises Private Limited, Zirakpur, to pay to the NRI Ragjinder Shah Singh an amount of Rs. 2.75 lakh as being the expenses he incurred to remove construction defects, harassment and service deficiency and another Rs 10000 as litigation cost. The company was asked by the three member full bench of the forum for compliance of its directions within a month. The bench also told the company that in case it fails to do so then it will have to pay an interest of 9% per annum.
In the complaint filed by Ragjinder Shah Singh he stated that on November 28, 2005 he had paid Rs 50000 as booking amount to the builder to book a three-bedroom flat at Savitry Towers in Zirakpur. The price of the flat had been fixed at Rs. 24.5 lakh and delivery for possession was slated for May 2007. Till May 28, 2007 the NRI had already paid in nine installments.
